By using this website www.ellonspirits.com and purchasing products on it, you agree to abide by these Terms & Conditions. You must not misuse this Website.
You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website.
Breaching this provision would constitute a criminal offence and www.ellongin.com will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
Product & Service:
Ellon Spirit Company Ltd reserves the right to modify or discontinue any product at any given time without any liability to the customer, or any third party.
Ellon Spirit Company Ltd cannot be held accountable for any variation in the colour, smell or flavour of our products. Ellon Spirit Company Ltd products are natural, and is therefore subject to natural variations.
The tasting notes on our website are written by our own tasting team, however spirit drink tasting is entirely subjective and different people will have a different experience of the same product. The tasting notes do not form part of the description of any product.
Ellon Spirit Company Ltd reserves the right, but are not obligated, to restrict sales to any individual, third party, jurisdictional region, or geographic region at our discretion.
All sizes, weights, capacities, dimensions and measurements indicated on our website have a small tolerance. The size of this tolerance is set by reference to applicable legislation (including Regulation (EU) No. 1169/2011, Directive 76/211/EEC and The Weights and Measures (Packaged Goods) Regulations 2006), & varies from product to product and from one size, weight, capacity, dimension or measurement to the next.
Age Restrictions
In the UK it is illegal for:
1. Any person under the age of 18 to buy (or to attempt to buy) alcohol for themselves or for any other person under the age of 18; and
2. An adult to buy (or to attempt to buy) alcohol for any person under the age of 18.
3. You may only purchase an alcoholic product from us if you are:
3a. At least 18 years old;
3b. Not buying that Product for any person or persons under the age of 18; and
3c. Of legal age to purchase alcohol both in the country where you place the order and the destination country.
By placing an order to purchase a product, you promise to us that it is lawful for you to order the relevant product in the country where you place the order and for the recipient to receive the relevant product in the destination country. If you breach this promise we may end the contract and charge you reasonable compensation for the net costs which we incur. We may deduct the compensation payment from the bank account which you used to pay for the product. We may make that deduction from that bank account in more than one payment.
Pricing:
All products are priced in GBP (UK Sterling)
• All prices found on Ellon Spirit Company Ltd website include VAT (if VAT registered) and other relevant taxes imposed by the government.
• Any costs included will be clearly stated.
• All prices and information present on Ellon Spirit Company Ltd website, and any literature derived from it, has been compiled with the greatest of care. However, Ellon Spirit Company Ltd does not guarantee all information is accurate or current.
• Ellon Spirit Company Ltd reserves the right to modify prices without a period of notice in line with any legal requirements in Scotland.
Payment:
Payment is made by credit or debit card..
No money is charged before the goods are dispatch. Eg; When the customer places an order we reserve the amount on their card, but we do not charge the card until goods have been dispatched.
Cancellations before dispatch will incur no charge, cancellations made after dispatch the customer must pay for return of goods.
Returns & Refunds
We will refund you using the same method which you used to pay.
You must return a product to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. Unopened and in a resalable condition.
To cancel or return goods please contact us via email k.murphy@ellongin.com quoting your order number and reason for cancellation/ return. Postage costs will be covered by the customer.

Please include a copy of the order paperwork which you receive from us, or at least a note of the order number, when you return the product to allow us to identify your order.
Remember that you do not have the right to cancel a contract & that your right to a refund may be reduced if damaged.
As you are a consumer (that is to say that you enter this contract otherwise than in the course of your trade or business), We are under a legal duty to supply a product that is in conformity with this Contract. As a consumer, you have legal rights in relation to a product that is faulty or not as described. These legal rights are not affected by your right of return and refund.

Please do not return items until we have confirmed receipt of your email.
Damaged Items:
Should an order arrive damaged, please contact us immediately at k.murphy@ellongin.com with information & photographs attached. We ask for the photographs as evidence to show the shipper. We appreciate your co-operation.
Delivery Method:
Subject to items being in stock. All products are shipped from the UK. Orders will be dispatched within 3 working days. Delivery costs will be calculated at checkout depending on where you live & weight of the package.
We will give you an estimated delivery date along with the Dispatch Confirmation. Occasionally our delivery to you may be affected by an event outside our control. Below is our responsibilities when this happens.
If no one is available at your address to take delivery and you give us no other instructions at the time of placing your order, our carriers will usually:
1. Leave your parcel in a safe place;
2. Leave your parcel with a neighbour; or
3. Leave you a note which informs you that they have attempted to deliver the Product (if this happens, please contact the carrier to re-arrange delivery). If you have any specific delivery instructions, you should give them when you place your order for a Product.
Ellon Spirit Company Ltd does not take responsibility for customs fees, customs delays and other customs problems.
Ellon Spirit Company Ltd does not take responsibility for delivery times. We post all items promptly but local couriers determine delivery time. Please note, local holidays & adverse weather may impact postal delivery times.

You may link to our home page or any other page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. This also apply to sale items. The initial shipping costs will be refunded. Our customers only pay for the cost of returning the product.

2 Every time you order a Product from us, the Terms in force at the time of your order will apply to the Contract between you and us.
3 We may revise these Terms as they apply to your order from time to time to reflect the following circumstances:
3.1 changes in relevant laws and regulatory requirements; and
3.2 changes in the way that we do business.
